Conservation Litigation introduces use of remedies to young lawyers with Legal Voices for the Future.

On 25 October 2023 Maribel was invited to the monthly meeting of “Legal Voices for the Future” (LVF) to share her experience on remedies with an audience of young lawyers.

LVF is a collaborative learning forum established by early career practitioners from different fields of law. The session last October was devoted to discussing Exemplary Damages and the Environment. After a brief and informative presentation on exemplary damages in the UK by Joe Hodson, the host interviewed Maribel about the use of remedies in environmental harm cases. They also discussed the deterrent aspect of remedies and how innovative legal tools should be used in combination to unpack the full potential of law to combat the most pressing environmental issues of our time.

“Ecocide, rights of nature, enhancing corporate responsibility and remedies are all legal tools that aim for the same goal: to provide effective legal solutions to environmental problems,” explains Maribel.

“Rather than seeing them as mutually exclusive tools, we should strive to use them in combination and strategically. Ecocide and rights of nature still need to find their place in many legal systems, whereas the obligation to remedy and compensate for biodiversity harm is in the laws of quite a number of countries already.

We at Conservation Litigation work to enforce those obligations and whenever the opportunity arises we will surely combine it with other legal tools”.
